His attorney wrote, “The dismissal of charges reflects what we have told the government all along—that Mr. McKinley was peripherally involved with the other defendants and never knowingly participated in any criminal activity, much less defrauded anyone.” McKinley did plead guilty to a misdemeanor charge of misrepresenting the health benefits of one of his supplements.
In the court ruling, the judge recognized that the crime he was ultimately convicted of was both victimless and not knowingly fraudulent. It carried a 12-month probationary sentence. Following the dropped charges, McKinley is now free to resume all business interests.
